Armenia seeks to take Azerbaijan’s non-compliance with ICJ ruling to UN Security Council

Armenia is “working” in the direction of raising the issue of Azerbaijan’s non-compliance with the world court order on unblocking the Lachin Corridor at the UN Security Council, the Representative of Armenia on International Legal Matters Yeghishe Kirakosyan told lawmakers Monday. The United Nations’ highest court – the International Court of Justice (ICJ) - ordered Azerbaijan on February 22 to “take all steps at its disposal” to ensure unimpeded movement of persons, vehicles and cargo along the Lachin Corridor in both directions. The Lachin Corridor has been blocked by Azerbaijan since 12 December 2022.  Kirakosyan was asked to comment on the matter by Hayastan faction Secretary Artsvik Minasyan at the parliamentary committee on state-legal affairs hearings. Minasyan asked Kiraskoyan whether or not it’s possible for the UN Security Council to consider applying the sanctions under chapter 7 of the UN Charter. Kirakosyan reiterated that the ICJ ruling is binding and Azerbaijan must comply with it. “Unfortunately we are facing the reality that Azerbaijan is simply ignoring the ruling, furthermore not only is it ignoring it but it is trying to distort the content of the ruling on the highest official level up to the lowest official level. This was recently seen in the Azerbaijani Foreign Minister’s letter addressed to the UN Secretary General, to which our minister’s letter has been submitted as a response,” he said. Kirakosyan said that article 94 of the UN Charter provides for a certain narrow description pertaining to the rulings. But attempts in the past to bring rulings on provisional measures before the UN Security Council have failed. The cases related to a permanent member, who exercised its right to veto and the issue didn’t make it to final debates. “But in our case I think we should work in that direction. I know that our colleagues at the foreign ministry are working in that direction. It is highly important for the matter to enter the agenda at the UN Security Council. And we must maximally utilize all diplomatic channels to ensure a favorable discussion of the issue,” Kirakosyan said. Taking the issue to the UNSC has two perspectives, he added. First is the formal point of view, there’s article 94 of the charter which gives such an authority to the Security Council. The second logic is chapter 7 of the UN Charter – its mandate for ensuring international peace and security. “The idea is that the non-fulfillment of this ruling creates risks for international peace and security. So we have the chance to raise this issue at the Security Council at least under two logics. It is obvious that the non-compliance with the court’s decision, that is the continuation of the blockade, creates very serious risks for international security.”

The normalization of relations with Hungary, without remorse on the part of the latter, without condemnation of Safarov's heroization policy, will be another humiliation of the dignity of the Armenian people, MP of the "Armenia" fraction Anna Grigoryan stated today.  "In 2012, Armenia severed diplomatic relations with Hungary after it extradited Ramil Safarov, an Azerbaijani who axed Gurgen Margaryan while he was sleeping in Budapest, despite the fact that Safarov was sentenced to life in prison for 30 years without parole. It is extremely important to record not only the fact of the extradition itself but the fact that the motive of the extradition was the promise of providing millions of dollars by Azerbaijan. In fact, Hungary extradited the murderer Safarov, and then the latter was made a hero in Azerbaijan, and Hungary remained silent, did not condemn, did not call for Azerbaijan to unconditionally fulfill the Hungarian court's verdict, and what is more important, did not repent and apologize." Anna Grigoryan said, today Hungary has the status of an observer in the Organization of Turkic-Speaking States, moreover, the Minister of Foreign Affairs of Hungary considered the Forum of Turkic-Speaking States a peace forum, and expressed his solidarity with Azerbaijan in the unleashed war against Artsakh. "Actually, not only years ago, but also today, Hungary justifies Azerbaijan's murderous policy against the Armenian people, and today's government cites the fact that Hungary provided vaccines to Armenia during the coronavirus pandemic and mediated the return of Armenian prisoners of war as a reason for the normalization of relations. and so on." According to the deputy, however, Hungary is not to blame. "Hungary auctioned the blood of an Armenian man, Gurgen Margaryan, and if Armenia goes to the normalization of relations without Hungary's acceptance of this guilt, repentance, it means that Armenia is also in solidarity with this decision made by Hungary in time," she said. It should be reminded that on December 1, within the framework of the OSCE Ministerial Forum, the meeting of the Foreign Ministers of Armenia and Hungary, Ararat Mirzoyan and Péter Szijjártó, took place. At the meeting, the parties agreed to restore full diplomatic relations, and also, as a continuation of the meeting, the two governments should appoint non-resident ambassadors to explore the possibilities of developing relations, especially in the fields of trade, culture, education, and tourism.

Pashinyan reminded that it's about the position of the RA government regarding the proposals of the Russian Federation, the essence of which was to postpone the Nagorno-Karabakh issue for some time. "When this question was asked, there were statements in the opposition field and in Nagorno-Karabakh demanding the government to accept the proposals of the Russian Federation. I want to say that the Government accepted this agreement a long time ago, since January 2021, but did not talk about it purely out of correctness," he said. The Prime Minister emphasized that the current position of the government is what the opposition demanded from them, not knowing that the government adopted that position a long time ago. He expressed that he had shared this position with the NK president a long time ago. The Prime Minister also mentioned that if the opposition now has a different opinion, and considers that RA should reject RF's proposals, it would be right to announce it loudly.

armenpress.am: Arayik Harutyunyan, Chief of Staff at the Office of the Prime Minister of Armenia, assures that there is a certain tactic in the negotiation process over the Artsakh issue, adding that with its behavior the opposition cannot force the leadership to deviate from that plans. When asked to comment what the leadership is discussing behind closed doors regarding the ongoing campaigns of the opposition, Arayik Harutyunyan said what is behind closed doors is also behind open doors, the government is taking into consideration the realities. He said the government is public in its actions, statements in the Parliament, during the Cabinet meetings, interviews and contacts with the press. Commenting on the opposition’s actions when they are protesting outside different ministries and demand assurances from the representatives of the authorities that Artsakh will never be part of Azerbaijan, Harutyunyan said: “If opposition is partnering, it will get partnering answers. If opposition presents some demands and goes beyond morality, civilization, of course, the leadership must respond to it from above, but if opposition continues acting in the same way, it will just be rejected. Look at how that opposition was behaving when they infiltrated in the Foreign Ministry building, how it was behaving with the people who are negotiating for the Artsakh issue, with the Foreign Ministry which implements the government’s action plan which clearly outlines also the settlement of the Artsakh issue, with the deputy foreign minister who is going to negotiate”. According to Harutyunyan, the opposition is a weak opposition, and its influence is also weak, but nevertheless, it creates problems in the foreign policy field for the activity of these persons. “The leadership makes statements and confirmations when it is necessary. There is a negotiation process, and there is a certain tactic in that negotiation process. And it is not the opposition that should force the government and the leadership to deviate from those plans”, he said, adding: “I want everyone to help the leadership which last year received the vote of the majority of our people. Everyone must respect that vote, not the government and the leadership, but that vote. Our people gave these answers about a year ago, and now trying to deviate some agendas out of despair, sorry, but the current leadership of Armenia is not going to deviate from its strategy and tactic under the influence of a small group”, he said.

MP of the "Armenia" (Hayastan) faction, Deputy Speaker of the National Assembly Ishkhan Saghatelyan spoke at the rally. In his speech, he presented what the next authorities will do in the event of a change of power, Saghatelyan noted his ideas about achieving peace, gave four fundamental points. "In the situation that has developed after the 44-day war, Armenia tactically needs to refrain from hasty, dangerous and fatal steps until the relative stabilization and clarification of the alarming geopolitical situation. Secondly, to create a safe atmosphere that will be predictable and perceived by a strategic ally and other important regional and international partners, in order to ensure effective and pro-Armenian security mechanisms in the conditions of creating a new world order. Thirdly, to immediately develop and implement a promising concept in all military, military-industrial, technological, economic and infrastructural areas. Fourth, to unite the full potential of all Armenians, and the Diaspora should become a participant and responsible for the implementation of the tasks of the pan-Armenian agenda," Saghatelyan said. Speaking about the Armenian-Azerbaijani actions, the opposition NA Vice Speaker said that Armenia should propose to divide the agenda of the negotiations into two stages. "We are convinced that ensuring real peace, reconciliation and coexistence must necessarily be preceded by mutual agreements on unresolved issues, therefore Armenia should propose dividing the agenda of the Armenian-Azerbaijani negotiations into two stages: the first stage is the clarification and coordination of the principles of the settlement of relations, the second stage is negotiations on the peace treaty and, if necessary, the conclusion of the treaty," he said. Ishkhan Saghatelyan said that peace should not be a concession to the vital interests of the Armenian people, but should be worthy.

According to Saghatelyan, this movement over the past 30 years in the independent history of Armenia is unique in its scope, size, popularity and, in fact, is the second Karabakh movement. When asked what kind of Armenia a citizen will have after the opposition comes to power and what the opposition as a whole will bring, Ishkhan Saghatelyan replied: "This government promised love, solidarity, but brought hatred and division, promised investment, but there is no investment, people live worse - this is an obvious fact. They promised security, well-being, and promised that no decisions would be made on the issue of Artsakh without the people: here, too, they completely failed. They promised democracy, freedom of speech, but you see what is happening in Armenia." According to Saghatelyan, people were deceived in all directions and spheres. Saghatelyan noted that all the promises that were made to society and were not fulfilled in 2018, the opposition will fulfill all those promises.

"Artsakh, Armenia's independence are under threat. Because of the anti-national authorities. We must correct this situation. Is it possible? Of course, yes. How? The way out is to create a strong Armenia with a progressive chain of security and solidarity. In order to create a strong Armenia, we must first remove them and form a government that will ensure the deterrence of Turkish-Azerbaijani foreign aggression, modernizing the unified security system of Armenia and Artsakh, it should be based on the involvement of strategic partner countries, the reconstruction of the Armenian armed forces, and international diplomacy of a new quality," Saghatelyan said. According to Ishkhan Saghatelyan, this government should confirm Armenia's commitment to be a guarantor of security and the right of the people of Artsakh to self-determination, excluding any status of Artsakh within Azerbaijan. "The new government will exclude the provision of a corridor to an enemy country under the guise of unblocking communication routes at the expense of Armenia's sovereignty and territorial integrity.  In Armenia-Turkey relations, it will rule out any agreement that will cast doubt on the fact of the Armenian Genocide. I sincerely and responsibly declare: anyone who has previously shown unacceptable behavior on the part of society will not play any role in the future government, will not have any privileged status. The most important task will be the return of Armenian POWs, hostages and other detainees. It is assumed that the activity of the provisional Government will be 1-1,5 years, after that the government should organize free, fair, competitive elections.
